Please find below the terms and conditions which are offered by WorldSIM.com. These
terms and conditions apply to the use of goods and services offered by us. By placing
an order through us it is assumed that you agree to be bound by these terms. If
you do not agree to these terms, please refrain from placing an order through us.
Amendments
We reserve the right to update the terms from time to time and any changes will
be notified to you via a suitable announcement on the website. It is your responsibility
to check for any such changes. The changes will apply to the use of the Website
after we have given such announcement. If you do not wish to accept the new Terms
you should not continue to use the website. If you continue to use the Website after
the date on which the changes come into effect, your use of the Website indicates
your agreement to be bound by the new Terms.

You:
- Agree not to use the Website (or any part thereof) for any illegal purpose and agree
to use it in accordance with all relevant laws;
- Agree not to upload or transmit through the Website without limitation, any computer
viruses, macro viruses, trojan horses, worms or anything else designed to interfere
with, interrupt or disrupt the normal operating procedures of a computer;
- Will not upload or transmit through the Website any material which is defamatory,
offensive, or of an obscene or menacing character, or that may cause annoyance,
inconvenience or needless anxiety;
- Will not use the Website in a way that may cause the Website to be interrupted,
damaged, rendered less efficient or such that the effectiveness or functionality
of the Website is in any way impaired;
- Will not use the Website in any manner which violates or infringes the rights of
any person, firm or company or the rights thereof (including, but not limited to,
rights of intellectual property, rights of confidentiality or rights of privacy);
- Will not attempt any unauthorised access to any part or component of the Website;

- Agree that in the event that You have any right, claim or action against any other
User arising out of that User's use of the Website, then You will pursue such right,
claim or action independently of, and without recourse to Us;
- Agree to be fully responsible for all claims, liability, damages, losses, costs
and expenses, including legal fees on a full indemnity cost basis, suffered by Us
and arising out of any breach of the Conditions by You or any other liabilities
arising out of Your use of the Website, or the use by any other person accessing
the Website using Your Internet account and/or Your Personal Information.

- When you shop on this Website, we will ask you to input personal details in order
for us to identify you, such as your name, e-mail address, billing and delivery
address and Credit card or other payment information. We confirm that this information
will be held by us in accordance with the registration we have with the Data Commissioner's
Office and collected lawfully in accordance to the Data Protection
Act 1998.We will

whether this be by fax, post telephone, e-mail, SMS and you do not consider any
of the above as being a breach of any of your rights under the Telecommunications
(Data Protection and Privacy) Regulations 1999.
- You should be aware that if the police requests us or any other regulatory authority
investigating suspected illegal activities to provide your personal information,
we are entitled to do so.

secure. We cannot be held liable for any losses caused as a result of unauthorised
access to information provided when accessing or ordering from the website.

a. As a convenience to our customers, the Website
may include links to other websites or materials beyond our control. For your information,
we are not responsible for such websites or material nor do we review or endorse
these. We will not be liable, whether directly or indirectly, for the privacy practices or content of such websites or for any damage, loss or offence caused or alleged
to be caused in connections with, the use of or dependence on any such advertising,
content, products, materials or services available on such external websites or
resources.
7. Purchase Of Goods ( Order)
a. All orders are subject to acceptance and
availability. If the goods or services you have ordered are unavailable at the time
of order, you will have the option to either wait until the item is in stock or
you may cancel your order.
b. Any orders placed by you, will be treated
as an offer to purchase the goods or services offered by WorldSIM.com, and we reserve
the right to reject such offers at any time.
c. Any automated reply or acknowledgement
of your order that you may receive from us does not indicate an acceptance of your
order. Depending on which is the earlier, the conclusion of a contract between you,
the Consumer, and WorldSIM.com, will take place when we dispatch the goods to you
or commence the services.
d. The receipt of the automatic acknowledgement
creates no formal contractual relationship.
e. Orders for any product can be placed via
our secure Online Server or by telephoning our Online Customer Service team.
f. You permit that the user Information that
you are required to provide when you make an offer to buy Goods or Services via
our Website is true, accurate, current and complete in all respects to the best
of your knowledge.
8. Payments
a. You can make Payment by any major credit or debit card Visa,
Visa Delta, Switch, Solo, MasterCard and American Express. If you do wish to pay
by Personal Cheque or Postal Order please contact our Online Customer Service team.
Payment will be debited and cleared from your account before the dispatch of your
Goods or provision of the Service to you. You confirm that the credit/debit card
that is being used is yours.
b. All credit/debit cardholders are subject to validation checks and authorisation by the Card issuer and we may share your personal information
with such third parties as are necessary to enable us to do such checks. If the
issuer of your payment card refuses to authorise payment to us, we will not be liable
for any delay or non-delivery.
c. Please be advised that in some instances when orders exceed
£100, WorldSIM.com may require customers to fax proof of identity i.e. either driving
License or utility bill and a bank statement of the credit card you are paying with
along with a copy of your credit card. The co-operation of our customers is appreciated,
as this will help us reduce fraudulent orders.
9. Delivery
a. The cut off time for next day delivery is 2:00 PM. The last
order day for next day delivery service is Friday. Orders placed on weekends will
be delivered on Tuesday. If you require urgent next day delivery at weekends,
call the sales team to quote you on a special weekend next day delivery service
charge.
b. If you are not at home when we deliver a non- delivery card
will be posted through your letterbox, which advises that we tried to deliver. You
will then be required to call the number on the card to arrange alternative date
of delivery.
c. Please note that due to security reasons we cannot deliver
products to any other addresses only the address where the Credit / Debit card is
registered.
d. If for whatever reasons we are unable to fulfil the agreement
to supply you with your goods will offer a refund on your debit/ credit or suggest
an alternative product.
e. If your goods fail to arrive within 28 days of dispatch,
you will have the option of either a full refund or a replacement shipment.
f. Where an incorrect address has been given to WorldSIM.com
with the order we reserve the right to charge for any extra carriage costs incurred.
10. Product Warranty
a. All products come with a 12-month manufacturer's warranty
unless otherwise stated. This warranty does not affect your statutory rights, which
cannot be excluded or restricted at law.
11. Cancellations and Returns
a. If you wish to cancel an order prior to receipt of the goods,
you must do so by informing us in writing within 48hrs of placing the order. You
can do so by emailing us at: cancelorders@WorldSIM.com
b. In the event that the goods are in transit when the cancellation
is requested, you must not accept the delivery of the goods. Request for cancellation
must still be in writing.
c. If you have received the goods, you must return all items
for cancellations within seven days of receipt. Please call and request a RMA number
for the return.
d. If you are requesting a cancellation of an order that included
free accessories and gifts, these must also be returned. If they are not returned,
WorldSIM.com reserves the right to charge the RRP (Recommended Retail Price) applicable
at the time of purchase for the items, prior to cancellation. If WorldSIM.com is
not successful in retrieving the costs, the cancellation will not be processed.
e. It is the customer's responsibility for the safe returns
of all goods. All items must be returned as they were received with the original
packaging and full contents included, along with documentation and proof of purchase.
Items returned in a less than pristine condition or damaged or missing packaging
will incur charges to cover the cost of the items. WorldSIM.com will pursue these
charges. You, the consumer, are responsible for all dispatch costs for returning
items, unless the handset is faulty.
f. If an item is not in the same condition as when supplied,
WorldSIM.com reserves the right to refuse cancellation, or apply an additional charge
to compensate.
g. If WorldSIM.com has refused cancellation, return of the
item to the consumer will be at their own cost.
h. All items returned must be sent with the original receipt
issued by WorldSIM.com
i. If a refund is due please allow 28 days from cancellation
for funds to be credited. Funds will be credited to the credit/debit card used at
the time that the order was placed.
12. Faulty or Damaged Goods
a. If your goods arrive faulty or damaged, or a fault occurs
in the first 7 days after Delivery, we will either provide a full refund or dispatch
new goods as soon as possible after the faulty goods have been returned.
b. When Returning Goods please include a note stating your
name, address, invoice number, and a detailed description for the fault or reason
for return.
c. Faulty Handsets will be exchanged during the first 7 days.
All phones are covered for the remainder of the initial 12-month period by the manufacture's
warranty.
d. If the goods are not faulty you have 7 working days from
the day after the goods arrive to cancel the order and return the goods for a refund
and call our online Customer Service team regarding the refund. A refund will be
provided within 30 days. (See conditions for cancellations and returns above.)
e. Where a refund is required for non-faulty items we reserve
the right to charge the initial cost of the delivery.
f. Refunds cannot be given if we judge that the product
has been willfully damaged, neglected, overloaded, modified, adapted or repaired.
g. If any returned goods are not faulty and the goods contain
software that has been opened a 30% restocking fee will apply.
13. SIM Card pricing
a. The £35 SIM card package consists of 3 elements. The
physical SIM card (£15), £10 of calling credit (£10), and access charge to on-line
billing (£10). Each element is invoiced separately, and when purchasing a
SIM Card, a customer may request not to have calling credit or access to the online
billing system. A customer wishing to do this, must e-mail
sales@worldsim.com
prior to placing their order. Such customer may at a future date request these
additional services.
b. Customers purchasing a SIM card without calling credit should
be aware that they will be unable to make calls or send texts, but may still be
able to receive calls in destinations where receiving calls are free.
14. Vat
a. All prices listed on the site include VAT where applicable
with the exception of charges for calls and texts for the global SIM services
which will only be chargeable on for calls and services originating in the EU.
b. For all customers in the UK and other European Union countries
- VAT is charged where applicable at 15%.
c. For all countries outside of the EU, for example USA, Switzerland
- no VAT is charged.
d. When ordering goods from WorldSIM for delivery overseas you may be subject
to import duties and taxes, which are levied once the package reaches the specified
destination. Any additional charges for customs clearance must be borne by you;
we have no control over these charges and cannot predict what they may be. Customs
policies vary widely from country to country, so you should contact your local customs
office for further information. Additionally, please note that when ordering from
WorldSIM, you are considered the importer of record and must comply with all laws
and regulations of the country in which you are receiving the goods. Your privacy
is important to us and we know that you care about
how information about your order
is used and shared. We would like our international customers and customers dispatching
products internationally to be aware that cross-border deliveries are subject to
opening and inspection by customs authorities.
15. Pricing
a. We reserve the right to change a price in exceptional circumstances.
If a price is corrected due to exceptional circumstances, customers will be informed
of the change before payment is processed and offered the opportunity to cancel
the order. Whilst we endeavour to ensure the prices on our website are as accurate
as possible,
b. If an order is placed for an item with an incorrect price,
and the incorrect price is less than the cost price of the item, we reserve the
right to offer to process the order at cost price or the opportunity for the customer
to cancel the order.
c. Prices on orders for out-of-stock or pre-release items are
valid for one week after the order is placed. If the price changes when stock becomes
available customers will be informed of the change before payment is processed,
and will be offered the opportunity to cancel the order.
d. All prices shown on our website are offers only and are
only confirmed at point of shipping.
16. Eligibility Of Purchase
a. To be eligible to purchase goods on this Website and lawfully
enter into and form contracts under English Law you must:

to which your credit card is registered.
- Register your real name, address, phone number, email address and any other details
requested.
- Holds a valid debit / credit card issued by a bank acceptable to us.
- By offering to purchase goods and services you represent to us that you are 18 years
of age or over and authorise us to transmit information (including updated information)
to obtain information from third parties including but not limited to, your debit
or credit card numbers or credit reports to verify or to validate your credit card,
to obtain an initial credit card authorisation and to authorise individual purchase
transactions.
Business Customers
- If you are a business or if the goods are used completely or in part for business
purposes, we shall not be liable to you for any business loss including loss of
profits, (Whether direct or indirect) data, revenue, goodwill, or incidental, or
consequential loss that you may suffer as a result of the purchase of goods from
us. Any other Liability shall be limited to the price paid for the goods.
General
- We reserve the right to decline any order for any reason.
- The laws of England govern all the above terms and conditions only the courts of
England will decide any disputes.
Copyright/Trademarks
- The trademarks, logos and service marks ("Marks") displayed on the Site are the
property of WorldSIMTM and other parties. Users are prohibited from using any Marks
for any purpose including, but not limited to use as meta-tags on other pages or
sites on the World Wide Web without our written permission or the permission of
such third party which may own the Marks. All information and content including
any software programs available on or through the Site ("Content") is protected
by copyright. Users are prohibited from modifying, copying, distributing, transmitting,
displaying, publishing, selling, licensing, creating derivative works or using any
Content available on or through the Site for commercial or public purposes.
20. Access to Password Protected/Secure Areas
- Access to and use of password protected and/or secure areas of the Site is restricted
to authorized users only. Unauthorized individuals attempting to access these areas
of the Site may be subject to prosecution.
21. Use of "Cookie" File Features
WorldSIM reserves the right to store information on a user's computer in the form
of a "cookie" or similar file for purposes of modifying the Site to reflect users'
preferences. The WorldSIM Privacy Statement provides additional information regarding
WorldSIM use of cookies as well as procedures for disabling cookies.
